The Demise of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis triggered by the announcement of a new comprehensive peace framework for ending the war appeared – briefly – to have been contained. A Washington representative spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: a renewed assault of missile and drone strikes on Kyiv.

The Rhythm of Peace Talks and Military Action

The succession of opposing developments captured the bleak nature of the recent timeframe. By day, negotiation efforts are fought: hopeful statements are released from different nations. Considerable effort is expended on restraining specific proposals. By night, Russian leadership brutally reminds the world that, for them, war remains the primary tool for achieving "settlement".

After-Dark Attacks

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's vulnerability was revealed. Ukraine is able to track projectile deployments from enemy soil, a capacity afforded by timely intelligence. From observation points, Ukrainian air force fighter jets that had been scrambled to engage hostile guided weapons streaked across the sky – sophisticated military planes supplied to Ukraine by NATO members.

Soon thereafter, Kyiv's air-defence systems activated: multiple launches deployed against a Russian ballistic missile. This was a sophisticated defense system at work, presumably delivered by partner states. Every deployment jolts you unexpectedly, rattling buildings. The moment of terror quickly transforms into grim resignation: perhaps the hostile projectile won't cause damage this time, sparing the city from devastation and additional electricity failures.

Continuous Dangers

Not long after, a large-caliber weapon opened up on a drone close by, part of a rapid response unit – probably imported technology. Regrettably, the bullets missed the opposing UAV – it pressed on overhead toward its target.

Periodically, this carried on until dawn. Kyiv awoke to the early updates: multiple fatalities, destruction and heating outages in numerous residences as a result of the night's assault. As always, everyone still went about their day – living the war. But those 24 hours illustrated Ukraine's essential dependence on external assistance – a need that regional partners are clearly incapable to substitute in the immediate future.

Ineffective Peace Efforts

The detailed framework from American leadership sparked intense emotion, debate and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after earlier high-level meetings and multilateral gatherings.

Every new proposal from American administration adheres to the same pattern: a political offensive against Ukraine, which Kyiv, with allied governments, effectively counters. They stabilise the situation but never actually secure success. This cycle will, undoubtedly, persist.

Strategic Calculations

It is tempting to accuse particular leaders of persistently promoting Moscow's conditions. But that does not seem to be the entire situation. American leadership works based on a assumption familiar among seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration assumes that it is unfeasible to force Russia to abandon the territory that it already controls in Ukraine's occupied territories.

The problem is that while recognising this factual reality, US leadership does minimal to deter Moscow, through words or deeds, from assuming that the status quo will not shift further in its advantage in the months ahead.

Divergent Views

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its partners are nearing depletion. Their reason to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to end hostilities, but they will continue as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, slowly losing lives and land but preventing a total frontline collapse until conditions improve in its benefit.

Current Realities

Realistically, there are no actual prerequisites for a armistice. Now, personal considerations are coming into play: leadership ambitions to broker a ceasefire and secure international recognition, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any initiative Kyiv finds unworkable, so that their focus does not shift toward domestic problems. And although their objective will now be significantly challenging after current events, it remains highly unlikely that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to eliminate the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by Washington, opposition by Ukraine and the rest of Europe, along with pacifying measures of representatives, and finally, recent disclosures, all achieved their purpose.

While new proposals based on previous concepts are imminent, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off political attacks from Washington that are rooted in Kremlin requirements and demonstrate certain reluctance to modify developments, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, largely rely on continued Western support.
